TERMS AND CONDITIONS

  • TRANSPORTATION AND HOTEL VOUCHERS
      Both parties agree that OPTUR VIAJES will use an electronic ticket printed on paper that will contain the full name of the passenger and hotel guest with a confirmation code, route and schedules which will be checked at the time of boarding the bus. They agree that "THE CLIENT" has the obligation to carry the original documents that prove their identity such as INE or valid passport. They agree that "THE CLIENT" must present their transportation and hotel coupons at the time of the trip, which in case of not carrying them its reprint will have a cost of $100.00 (ONE HUNDRED 00/100 MN) per coupon and itinerary.
  • JURISDICTION AND COMPETENCE
      For everything that is not provided for in this contract, as well as for its interpretation and compliance, both parties agree to voluntarily submit to the applicable laws and competent courts of the City of Monterrey, NL Renunciating from now on the jurisdiction that may correspond to them by virtue of your need, current or future address for any other reason.   • NON-COMPLIANCE OF SERVICES
      Both parties agree that in the event of non-payment by the "CLIENT" the advances paid to OPTUR VIAJES for the bus and hotel reservations will not be refundable without exception, nor will they be entitled to a discount of any kind. Both The parties agree that "THE CLIENT" is obliged by this legal instrument, to cover OPTUR VIAJES pending payments no later than 15 business days prior to the departure of the bus, by ignoring this or not providing it completely will give rise to the cancellation of the contract, the contracting party losing its advance payment rights, and will entitle OPTUR VIAJES and its representative to claim without the need for a trial the total payment of this contract at the precise moment of cancellation. They agree that OPTUR VIAJES reserves the right to cancel this contract and exclude from the trip the passengers or passengers who alter the order inside and outside the offices of OPTUR VIAJES located in Lic. Primo Truth #707 between Serafin Peña and Porfirio Díaz, Colonia Centro in Monterrey, Nuevo León, Mexico, as well as the expulsion of the passenger or passengers who disturb the order inside and outside the bus during the trip and who could endanger the physical integrity of the passengers and OPTUR VIAJES staff, as well as the smooth running of the trip.
  • CANCELLATION POLICIES
      Both parties agree that if the trip were to be suspended due to a fortuitous event such as fire or closure of highways, roads or bridges or due to natural causes such as earthquakes, floods, hurricanes, sudden changes in weather or any other cause beyond the control of both parties, they will remain mutually released from responsibility, but in any case the advance will be in favor of OPTUR VIAJES and the possibility will be negotiated by both parties and according to the availability of both parties and according to the availability of each one, the realization of a trip in later dates. They also agree that the trip may be canceled up to 24 hours before departure if a minimum of 35 passengers per bus does not meet, or it may leave in sprinter-type vans or similar, adapting the size of the vehicles to the number of passengers or relocate passengers to another destination that exists on the same departure dates or to the same destination on other departure dates with a hotel of the same category contracted. Outside of the above cases, if "THE CLIENT" decides to cancel the trip, both parties agree that the advances paid to OPTUR VIAJES by "THE CLIENT" will not be refundable. In the event that the trip is canceled by of OPTUR VIAJES, the advances and payments made for your trip will remain in favor of OPTUR VIAJES, for the completion of the trip on later dates.
  • TRANSFERS AND TOURS
      Both parties agree that OPTUR VIAJES grants the "CLIENT" a courtesy transfer to tours through an itinerary according to the destination of the trip with a minimum of 25 passengers, who must respect the meeting times at each site, in case any passenger is not in the place and within the indicated time the transfer will continue without them. with entry and transfer cost, will be paid by "THE CLIENT" without any exception since they are not part of this contract.
  • CONTRACT MODIFICATION
      Both parties agree that if before the departure of the trip "THE CLIENT" wishes to request a change of name (s), destination (s) or means of transport, the duration of the trip, the calendar or the itinerary of the trip contracted or to any condition related to the considerations established in this contract and as long as this is possible and OPTUR VIAJES can make them, this modification will suffer an additional charge in proportion to the cost of the changes made, plus an additional premium of 10% of the price of the trip. They also agree that OPTUR VIAJES does not accept any type of change referring to the place, date and time of departure and destination of the trip that is not contemplated in the previous clauses, any change by the "CLIENT" that is not mutually agreed in writing will leave OPTUR VIAJES free to cancel the trip, losing "THE CLIENT" his rights to advances and payments.
  • TRANSPORTATION POLICIES
      Both parties agree that OPTUR VIAJES is only an intermediary between passenger and bus, in case of delay the passenger must wait for the arrival of the unit and in case of breakdown, must wait for the repair of the unit or, where appropriate, its replacement, in the understanding that if one of these cases occurs, it does not give "THE CLIENT" the right to cancel the trip, the right to reimbursement or any compensation. They agree that "THE CLIENT" must appear at the place, date and time indicated in their transportation coupon for the departure of the trip no later than one hour in advance. They agree that in the event that "THE CLIENT" does not show up with the required notice, and for this reason will not board the bus foreseen for whatever reason, no advance payment will be returned and you will lose all right to reimbursement, being obliged to pay OPTUR VIAJES the amounts that are pending, since your absence is considered as a withdrawal of the contracted services. They agree that in the event of loss or damage to the "CLIENT's" luggage or valuables that he takes with him on the trip, they are his exclusive custody, safekeeping and risk, since OPTUR VIAJES does not assume any responsibility Both parties agree that the carrier is obliged to provide travel insurance to passengers and to transport their luggage with reasonable diligence, but sometimes without prior notice it is replaced by another carrier, this circumstance being able to modify some points of scheduled stops in the travel itinerary, for which the schedules provided in the transportation coupons may vary by virtue of the fact that the transfer time between origin and destination is estimated at a cruising speed of 95 km, per hour if the weather and traffic allows.
  • ACCOMMODATION POLICIES
      Both parties agree that OPTUR VIAJES is not responsible for the additional services that "THE CLIENT" requests from the hotel such as long distance calls, room service, food, drinks, servi-bar or any other, which will be paid by "THE CUSTOMER" as well as all damages and prejudices to the hotels or their furniture and facilities, of the damages and prejudices caused to other guests and third parties. They agree that the hours of occupation of the rooms depend on the rules established by the hotel, since that in general the rooms can be occupied after fourteen hours on the day of arrival and must be vacated before twelve hours on the day of departure, regardless of the time the arrival at the hotel is scheduled or the time the return is planned. They agree that triple or quadruple rooms are generally double rooms to which one or two beds are added, which are usually a sofa bed, except in n certain hotels where larger beds are used instead of additional beds.
