PRIVACY NOTICE related to personal data collected by Operadora Turística de Monterrey (Optur Viajes), and its affiliates or subsidiaries (hereinafter referred to as "OPTUR").

1.- General

1.1.- OPTUR IS A COMPANY COMMITTED TO AND RESPECTFUL OF THE RIGHTS REGARDING THE PERSONAL DATA OF INDIVIDUALS, RECOGNIZED IN ARTICLE 16, SECTION II OF THE POLITICAL CONSTITUTION OF THE UNITED MEXICAN STATES, AS WELL AS THE PROVISIONS OF THE FEDERAL PROTECTION LAW OF PERSONAL DATA IN POSSESSION OF INDIVIDUALS, ITS REGULATIONS AND OTHER APPLICABLE REGULATIONS. THEREFORE, THIS PRIVACY NOTICE IS MADE AVAILABLE TO YOU, IN ORDER THAT THE HOLDER OF THE PERSONAL DATA IS AUTHORIZED TO EXERCISE THEIR RIGHT TO INFORMATIONAL SELF-DETERMINATION.

1.2.- BY ENTERING AND USING THE INTERNET PAGE, WHOSE DOMAIN NAME IS www.opturviajes.com IN THE SECTION CORRESPONDING TO "PRIVACY NOTICE", HEREIN KNOWN AS "THE INTERNET PAGE", PROPERTY OF OPTUR, YOU ( THE HOLDER) DECLARES THAT IT IS UNDERSTANDING AND ACCEPTING THE TERMS AND CONDITIONS CONTAINED IN THIS NOTICE AND EXPRESSLY DECLARES AND GRANTS ITS ACCEPTANCE AND CONSENT USING ELECTRONIC MEANS FOR SUCH PURPOSE, IN TERMS OF THE PROVISIONS OF ARTICLE 1803 OF THE FEDERAL CIVIL CODE.

1.3.- IF THE HOLDER DOES NOT ABSOLUTELY ACCEPT AND COMPLETE THE TERMS AND CONDITIONS OF THIS NOTICE, THEY MUST REFRAIN FROM SHARING ANY TYPE OF INFORMATION WITH OPTUR BY ANY MEANS, INCLUDING ITS INTERNET PAGE.

1.4.- IN THE EVENT THAT THE HOLDER CONTINUES TO USE THE OPTUR INTERNET PAGE, BE IT TOTALLY OR PARTIALLY, SUCH ACTION SHALL BE CONSIDERED AS THEIR ABSOLUTE AND EXPRESS ACCEPTANCE OF THE TERMS AND CONDITIONS ESTABLISHED HEREIN.

1.5.- THE SOLE USE OF THE OPTUR INTERNET PAGE GIVES THE OWNER PUBLIC THE QUALITY OF OWNER (HEREINAFTER REFERRED TO AS THE “OWNER” OR THE “OWNERS”) AND IMPLIES THE FULL AND UNCONDITIONAL ACCEPTANCE OF EACH AND EVERY ONE OF THE GENERAL AND PARTICULAR CONDITIONS INCLUDED IN THIS PRIVACY NOTICE IN THE VERSION PUBLISHED BY OPTUR, AT THE SAME TIME THAT THE HOLDER ACCESSES THE MENTIONED PAGE.
THE PARTIES DECLARE THAT, AS THERE IS NO ERROR, FRAUD, BAD FAITH OR ANY OTHER VICTIM OF WILL THAT COULD NULLIFY THE VALIDITY OF THIS INSTRUMENT, BOTH AGREE TO BE SUBJECT TO THE TENOR OF THE PROVISIONS OF THE FOLLOWING:

2.- Definitions

2.1.- Holder. - The natural person (HOLDER) to whom the personal data identifies or corresponds.

2.2.- Responsible. - Natural or legal person (OPTUR) of a private nature who decides on the processing of personal data.

2.3.- Manager. - The natural or legal person who, alone or jointly with others, processes personal data on behalf of the person in charge.

2.4.- Treatment. - Obtaining, using (including access, handling, use, transfer or disposal of personal data), disclosure or storage of personal data by any means.

2.4.1.- Transfer. - Any communication of data made to a person other than the person responsible or in charge of the treatment.

2.4.2.- Referral. - The communication of personal data between the person in charge and the person in charge, inside or outside the Mexican territory.

2.5.- Third. - The natural or legal person, national or foreign, other than the owner or person responsible for the data.

2.6.- ARCO Rights. - Rights of access, rectification, cancellation and opposition.

2.7.- Implied Consent. - It will be understood that THE OWNER has consented to the processing of the data, when having made the Privacy Notice available to them, they do not express their opposition.

2.8.- Primary Purposes. - Those purposes for which personal data is mainly requested and for which the relationship between OPTUR and THE HOLDER is originated.

2.9.- Secondary Purposes. - Those purposes that are not essential for the relationship between OPTUR and THE HOLDER, but that with their treatment contribute to the fulfillment of OPTUR's corporate purpose.

3.- Identity and address of the person responsible for collecting the personal data.

3.1.- The person responsible for obtaining the personal data of the HOLDERS is OPERADORA TURISTICA DE MONTERREY (OPTUR VIAJES), (hereinafter referred to as OPTUR), who undertakes to respect the provisions of this Privacy Notice (in what hereinafter the "Notice"), which is made available to you in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the "Law" or "LFPDPPP" indistinctly) and is applicable Regarding the personal data of natural persons such as candidates, employees, clients and/or prospects for clients, suppliers and/or prospects for suppliers, distributors, as well as users of the OPTUR INTERNET PAGE, which OPTUR obtains for the purpose of of the activities of reservation and sale of tourist packages, tours, hotels.

4.- Personal data that is collected.

4.1.- The HOLDER acknowledges and accepts that OPTUR may directly and/or through managers, the following personal data, based on the relationship with each HOLDER:

4.1.1.- Candidates: General: full name, date and place of birth, age, sex, nationality, marital status, profession, official identification with photograph, image or photograph, address (street, exterior and interior number, neighborhood, code postal, delegation or municipality), local and/or mobile phone, email, social security number, RFC, CURP. Academics: level of studies, school, study period. Family data: names, age, education, telephone number and profession of parents, siblings, children and spouse. Economic data: bank account data (account number, CLABE, bank), income level and current expenses. Professional experience: name of the company, time you provided your services, address, telephone number, position held, reason for separation, name of your direct boss. Personal and work references: name, address, telephone, profession. Documentation in copy: curriculum vitae, official identification with photograph, social security number, birth certificate, proof of address and bank cover.

4.1.2.- Workers: General: full name, date and place of birth, age, sex, nationality, marital status, profession, official identification with photograph, image or photograph, fingerprint, signature, advanced electronic signature, address (street , exterior and interior number, neighborhood, postal code, delegation or municipality), local and/or mobile phone, email, social security number, RFC, CURP. Academics: level of studies, school, study period. Family information: names, age, schooling, telephone number and profession of parents, siblings, children and spouse, contact information in case of emergency. Economic data: bank account data (account number, CLABE, bank), income level and current expenses. Professional experience: name of the company, time you provided your services, address, telephone number, position held, reason for separation, name of your direct boss. Personal and work references: name, address, telephone, profession. Documentation in copy: curriculum vitae, official identification with photograph, RFC card, CURP, social security number, birth certificate, proof of address, proof of studies or professional card, bank cover.

4.1.3.- Clients and/or Prospective Clients: Full name, nationality, date and place of birth, age, sex, address (street, number, neighborhood, city, state, delegation or municipality, zip code), landline and/or mobile, email, credit and/or debit card data, bank account data (account number, CLABE, bank), billing data and address. Documentation in copy: official identification with photograph, teacher's credential, school credential, bank cover, copy of credit and/or debit card.

4.1.4.- Suppliers, Supplier Prospects and Service Providers: Full name, date and place of birth, age, nationality, profession, official identification with photograph, local and/or mobile phone, email, CURP, RFC, data bank details (name of the bank, account, CLABE, SWIFT, ABBA, in the case of international transfers), tax information, bank statements, name of the legal representative of the company, articles of incorporation of the company, power of attorney of the legal representative registered in the Public Registry of Property and Commerce, contact information and positions in the company, billing information and address (postal code, state, country, city or municipality, neighborhood, town, street, exterior and interior number), electronic invoice. Documentation in copy: official identification with photograph, tax identification card, RFC card, CURP, proof of address, bank cover, articles of incorporation of the company, power of attorney of the legal representative registered in the Public Registry of Property and Commerce.

4.1.5.- Distributors: Full name, date and place of birth, age, sex, nationality, official identification with photograph, address (zip code, state, country, city or municipality, neighborhood, locality, street, exterior and interior number ), landline or mobile phone, email, RFC, CURP, bank details (bank name, account, CLABE, SWIFT, ABBA, in case of international transfers), tax details, bank statements. Documentation in copy: Official identification with photograph, tax identification card, RFC card, CURP, proof of address, bank cover.

4.1.6.- USER OF THE OPTUR INTERNET PAGE: Full name, date and place of birth, age, sex, nationality, profession, official identification with photograph, image or photograph, address (zip code, state, country, city or municipality, neighborhood, town, street, exterior and interior number), email, landline or mobile phone, social media username, credit and/or debit card details, bank details (bank name, account, CLABE , SWIFT, ABBA, in case of international transfers). Documentation in copy: Official identification with photograph, proof of address, bank cover, copy of credit and/or debit card.

4.2.- THE HOLDER in this act, grants his express consent in terms of article 8 of the LFPDPPP, for OPTUR to process his personal data, including the so-called financial and/or patrimonial personal data contained in this clause, to comply with the purposes established in this Privacy Notice.
4.3.- OPTUR states that it will not process sensitive personal data of THE HOLDER of any kind.

4.4.- The HOLDER in this act, under oath to tell the truth, accepts that the data provided to OPTUR is true, current and correct. In addition, you agree to release OPTUR in peace and safe from any demand or claim, derived from errors in the data that you have given.

4.5.- OPTUR states that it may obtain the personal data of THE HOLDER through the so-called public access sources, in order to validate and update the data of THE HOLDER, respecting at all times the reasonable expectation of privacy, referred to in the article 7 of the LFPDPPP.

4.6.- OPTUR states that the Manager will solely and exclusively access and process the personal data of the HOLDER, in order to carry out the hiring and administration of personnel, as well as payroll processes, and must process the personal data in accordance with the instructions that OPTUR communicates in writing, exclusively for the fulfillment of the purposes of this Notice.
4.7.- FUTURA will use IP information (Internet Protocol, for its acronym in English Internet Protocol) to analyze any type of threat to OPTUR'S INTERNET PAGE, to collect demographic information, as well as for the processing of the anti-fraud module of OPTUR and the use of third-party anti-fraud tools to analyze and verify the information. However, the IP information will in no case be used to identify the HOLDERS, except when there is a probability of fraudulent activity.

5.- Purposes of the processing of personal data.

5.1.- OPTUR accepts and acknowledges that it may process the personal data of THE HOLDER, directly and/or through managers, in accordance with the type of relationship it has with THE HOLDER, for the following primary purposes:

5.1.1.- THE HOLDER – Candidate:
a) Contact THE HOLDER- Candidate, via email, landline or mobile phone, or by any other means that exists or may exist, in order to follow up and evaluate the experience and studies of THE HOLDER- Candidate , to know the feasibility of being selected and the possibilities of success of the same in the position that it intends to carry out.

b) Know the candidate's work experience, as well as their skills for the position they are trying to fill.

c) Make a file in physical and electronic format of THE HOLDER-Candidate that will be kept at the address of OPTUR, for up to 1-one year, in case of not being selected for the position that he intends to perform.

d) To carry out the processes of selection and administration of personnel in the government institutions that are required.

e) To contact the people that the candidate has indicated as personal and/or work references.

5.1.2.- THE HOLDER -Worker:
a) Make a physical and electronic file of the HOLDER-Worker that will be kept at the address of OPTUR.

b) Carry out the necessary procedures for registering, canceling or modifying the registration of THE HOLDER-Worker before the Mexican Institute of Social Security and/or the government institutions that are required.

c) Carry out the necessary procedures to obtain the debit card, for the deposit of salary and/or commissions and other benefits generated in favor of THE HOLDER-Worker.

d) Carry out the control of attendance and entry and exit times of the HOLDER-Worker to the OPTUR workplace.

e) Preparation of letters or contracts for the allocation of work tools required by the HOLDER-Worker for the execution of their work activities.
f) Carry out the process of payment of salary and benefits of THE HOLDER-Worker, as well as discounts of alimony required by court order.

g) Manage with airlines and hotels the business trips required by the HOLDER-Worker.

h) Issue the employment certificates required by the HOLDER-Worker.

i) Issue certificates of participation in courses, trainings, seminars or workshops organized by OPTUR.

5.1.3.- THE HOLDER–Client and/or Prospective Client:
a) Contact you by phone, by email, through social networks or by any other means, to attend to and follow up on requests for products and/or services.

b) To provide the HOLDER-Client with the products and/or services that OPTUR markets, in accordance with the requests made through any means, so that the HOLDER-Client can benefit from the services and/or products offered.

c) Contact the HOLDER-Client by any means, in order to make clarifications and follow up on payments or any other situation arising from the products and/or services provided by OPTUR, such as complaints or comments about them.

d) Register them and update the data in the internal business administration system, for access to personal data by authorized persons.

e) Make contact with the HOLDER-Client to carry out the management and collection of debts.

f) Make and store a physical file of the HOLDER-Client for the duration of the commercial relationship and for up to 10-ten years after the termination of the commercial relationship.

g) Preparation of electronic invoicing and credit notes derived from the products or services that OPTUR markets. Said invoices, both in physical and electronic format, and the credit notes, will be kept by OPTUR during the term of the commercial relations, and for 10-ten years after their termination.

h) Coordinate meetings with the HOLDER-Client via telephone, email, social networks, Skype or through any other means, whether in physical or digital format.

i) Generate a record in OPTUR's customer databases that will be kept for 5-5 years.

j) Carry out transactions with credit institutions that result from commercial operations.

k) In case of being a foreigner, to carry out the necessary procedures for the shipment of the products or the delivery of the services that OPTUR markets.

l) Use services in the cloud in order to make OPTUR's internal processes efficient.

m) To evaluate and verify the information of the HOLDER-Client for fraud mitigation.

n) To verify the information of the HOLDER-Client in OPTUR's anti-fraud system and/or with third-party anti-fraud tools.

o) To contact the HOLDER-Client with payment processors such as Conekta and OpenPay.

5.1.4.- THE HOLDER- Supplier, Prospective Supplier and/or Service Provider:

a) Register them in their accounting system for access to personal data by authorized persons.

b) Make the payments corresponding to the products or services granted to OPTUR, either in cash, check, deposit or bank transfer.

c) Know the location data of THE HOLDER- Provider for the distribution of the corresponding payments.

d) Contact the HOLDER-Provider by telephone, by email or by any other means, in order to clarify and follow up requests for services and/or products, about payments or any other situation derived from the products or services granted to OPTUR.

e) Generate a record and control in the OPTUR Suppliers database, which will be kept for the entire term of the commercial relationship and for 10-ten years after its termination.

f) Keep a physical and/or electronic file of the HOLDER-Supplier during the duration of the commercial relationship and for 10-ten years after its termination for any reason.

g) Use services in the cloud in order to make OPTUR's internal processes efficient.

5.1.5.- THE HOLDER- Distributor:

a) Contact you by phone, by email, through social networks or by any other means, to attend to and follow up on requests for products and/or services.

b) Treat the personal, patrimonial and/or financial data of the HOLDER-Distributor to provide the products and/or services that OPTUR markets.

c) Contact the HOLDER-Distributor by any means, in order to make clarifications and follow up on payments or any other situation arising from the products and/or services provided by OPTUR, such as complaints or comments about them.

d) Register them and annually update the data in OPTUR's internal software, platforms and/or portals, for access to personal data by persons authorized to do so.

e) Make and store a physical file of the HOLDER-Distributor during the duration of the commercial relationship and for up to 10-ten years after the termination of said relationship.

f) Preparation of electronic invoicing and credit notes derived from the products and/or services that OPTUR markets. Said invoices, both in physical and electronic format, and the credit notes, will be kept by OPTUR during the term of the commercial relations, and for 10-ten years after their termination.

g) Carry out transactions with credit institutions, resulting from commercial operations.

h) Use cloud services in order to streamline OPTUR's internal processes.

i) Generate a record in the OPTUR distributor databases that will be kept for 10-ten years.

5.1.6.- THE OWNER-User of the OPTUR INTERNET PAGE:

a) Contact the HOLDER-User by telephone, email, social networks, Skype or by any other means, to attend to and follow up on their comments or requests made through the OPTUR INTERNET PAGE.

b) To access the social networks in which OPTUR participates.

c) Send information and promotions, upon request made by the HOLDER-User, through the form available on the OPTUR INTERNET PAGE, under the "Contact" tab.

d) Store in different databases, in physical or electronic format, the information of the HOLDER-User; Said records will be stored for a term of 5-five years counted from the date they are obtained, provided that commercial operations with OPTUR are not carried out.

e) To verify the information of the HOLDER-User in OPTUR's anti-fraud system and/or with third-party anti-fraud tools.

f) To contact the HOLDER-User with payment processors such as Conekta and OpenPay.

5.1.7.- OPTUR may process the HOLDER's personal data for the following secondary purposes:

a) In the case of the HOLDER-Client, evaluate the quality of the services and/or products offered, as well as the quality of attention to their comments or requests.

b) Carry out internal studies on consumption habits.

c) To provide you with additional communications, information and promotions, new product launches, image changes, newsletters and news.

d) Inform via email about changes or new products or services that are related to the one requested by the HOLDER.

e) Generate internal reports on the use of OPTUR'S INTERNET PAGE.

f) Mass mailings of mail marketing.

g) To contact the HOLDER-User in order to inform them of updates to THE OPTUR INTERNET PAGE, informative messages and messages related to services, including important security updates.

h) To mention the HOLDER-Client with that character in the corporate profile and on OPTUR'S INTERNET PAGE.

i) To inform them and/or invite them to participate in courses, trainings and/or events organized by OPTUR.

j) Send year-end greetings emails to the HOLDER-Client.

k) To share information about the HOLDER-Client and the HOLDER-User with other companies in the OPTUR group to promote services and promotions.

5.2.- In the event that THE HOLDER does not want their personal data to be used for all or some of the Secondary Purposes established in section 5.1.7., they must send a request to delete their data, specifying the purposes for those you want your personal data not to be processed, to the following email: privacy@opturviajes.com

6.- Use of “Cookies” and “web beacons”

6.1.- It is possible that OPTUR'S INTERNET PAGE makes use of "cookies" in connection with certain features or functions. Cookies are specific types of information that a website transmits to the HOLDER's computer hard drive for record keeping purposes. Cookies can be used to facilitate the use of a website, by saving passwords and preferences while THE OWNER browses the Internet. THE OPTUR INTERNET PAGE does not use cookies to obtain personal identification data from the HOLDER's computer that was not originally sent as part of the cookie.

6.2.- On the other hand, "web beacons" are images inserted in an Internet page or email, which can be used to monitor the behavior of a visitor, such as storing information about the user's IP address, duration of time of interaction on said page and the type of browser used, among others.

6.3.- Although most browsers accept cookies and web beacons automatically, THE HOLDER can configure their browser so that they are not accepted.

6.4.- To disable cookies, you must follow the instructions below:

6.4.1.- On a PC: open the Internet browser, enter the “Tools” menu, enter “Internet Options”, choose the “Privacy” tab, move the cursor from Settings to “Block all Cookies".

6.4.2.- On a Mac: open the Internet application, go to “Preferences”, choose the “Security” option, choose “Never” in the “Accept Cookies” option.

6.5.- OPTUR informs the HOLDER that, although it is their power to disable cookies, if they do so, the OPTUR INTERNET PAGE will not work for the sale of bus tickets.

7.- Limitations for access and disclosure of personal data

7.1.- OPTUR undertakes to make its best effort to protect the security of the personal data that THE HOLDER is giving it, through the execution of legal acts, the use of technologies that control access, use or disclosure without authorization of the personal information as well as the encryption of the personal data to which they treat; for this purpose, personal information is stored in databases with limited access that are located in controlled facilities with security mechanisms; OPTUR undertakes that the information provided by THE HOLDER is considered confidential and used in full privacy.

7.2.- In this sense, OPTUR undertakes to take the necessary measures to guarantee that the Managers it uses comply with the provisions of this Privacy Notice, with the obligations under its charge and, particularly, with the provisions established in article 50 of the LFPDPPP Regulations.

7.3.- Likewise, OPTUR undertakes to contract cloud computing services that process the personal data of the HOLDERS, provided that they respect the provisions of article 52 of the LFPDPPP Regulations.

7.4.- Additionally, you are informed that in order to avoid receiving publicity in general, you can register in the Public Registry to Avoid Publicity, for more information you can review the website of the Federal Consumer Protection Agency (PROFECO) and additionally, Another way in which you can limit the processing of your personal data is the Public Registry of Users that the National Commission for the Defense of the User of Financial Services (CONDUSEF) has.

8.- Designated to process applications

8.1.- In the event that THE HOLDER needs to revoke their consent, as well as Access, Rectify, Cancel, Oppose the processing of the personal data they have provided, they must do so through the person designated by OPTUR whose data is described below :

9.- Means to revoke consent

THE OWNER of the personal data may revoke the consent that is granted with the acceptance of this. Said revocation of the consent that is granted by electronic means, must be done observing the following procedure, using the following format:

9.1.- Send an email in attention to the Designated in point 8-eight of this Notice, through which said requests will be answered.

9.2.- Send a request or data message to the email specified above, indicating:

9.2.1.- The full name of the HOLDER, address and email to receive the response generated due to your request;

9.2.2.- The reason for your request

9.2.3.- The arguments that support your request or petition;

9.2.4.- Official document proving your identity and showing that you are who you say you are; and

9.2.5.- Date from which the revocation of your consent becomes effective.

9.3.- OPTUR will notify THE HOLDER, within a maximum period of 20-twenty days, counted from the date on which the request regarding the exercise of ARCO rights was received, the resolution adopted, so that, if appropriate, the same becomes effective within 15-fifteen days following the date on which the response is communicated, by means of a message containing that it has executed all the acts tending not to process the personal data of THE HOLDER.

10.- Means to exercise ARCO rights

10.1.- In the event that THE HOLDER needs to Access, Rectify, Cancel or Oppose the personal data that they have provided to OPTUR, the HOLDER must follow the following procedure, using the following format:

10.2.- Send an email in attention to the Designated of point 8-eight of this Notice, through which said requests will be attended, indicating the following:

10.2.1.- The full name of the HOLDER, address and email to receive the response generated due to your request;

10.2.2.- The reason for your request;

10.2.3.- The arguments that support your application or petition;

10.2.4.- Official document proving your identity and showing that you are who you say you are;

10.2.5.- Clear and precise description of the personal data with respect to which one seeks to exercise any of the ARCO rights, and any other element or document that facilitates the location of the personal data.

10.2.6.- In the case of requests for rectification of personal data, the HOLDER must indicate, in addition to what is indicated, the modifications to be made and provide the documentation that supports his request.

10.3.- OPTUR will notify the HOLDER, within a maximum period of 20-twenty days from the date on which the request for access, rectification, cancellation or opposition was received, the resolution adopted, so that, if appropriate, make it effective within 15-fifteen days following the date on which the response is communicated. In the case of requests for access to personal data, the delivery will proceed after proof of the identity of the applicant or legal representative, as appropriate.

11.- Transfer of personal data

11.1.- OPTUR undertakes not to transfer or share the data referred to in this Notice, in favor of third parties, except in cases that are necessary to comply with the purposes of this notice, or, are necessary in compliance with a request for authority.

11.2.- Likewise, in compliance with its legal obligations, and for informative purposes to the HOLDER, it is indicated that OPTUR may make the following transfers:

11.2.1.- IMSS, INFONAVIT and SAT, in order to comply with labor legislation, social security, as well as the payment of taxes.

11.2.2.- Banking institutions, in order to collect or pay for products or services, or pay workers' salaries, which OPTUR requires or offers for its clients, suppliers and workers.

11.3.- Notwithstanding the foregoing and, in the event of security breaches occurring at any stage of the treatment, which significantly affect the patrimonial or moral rights of the HOLDERS, they will be informed by email, immediately. , so that the latter can take the corresponding measures to defend their rights, disclaiming OPTUR from any responsibility, if the violation is not attributable to it.

12.- Other privacy policies
